Official Rules

1. Agreement
Please read these official rules (the “Official Rules”) carefully. They contain important information about your rights and obligations, as well as limitations and exclusions that may apply to you if you enter the Jovē Summer Refresh Spa Getaway (the “Giveaway”) sponsored by Jovē Wellness, LLC (the “Sponsor”).
By participating in the Giveaway, you signify your agreement to these Official Rules and the decisions of the Sponsor and RAVEN5 Ltd. (the “Administrator”). If you do not agree to the Official Rules, you may not enter the Giveaway.
2. Giveaway Period
The Giveaway begins at 12:00:01 AM Eastern Time (“ET”) on August 1, 2022 and ends at 11:59:59 PM ET on August 31, 2022 (the “Giveaway Period”). Sponsor’s database clock will be the official timekeeper for this Giveaway.
3. Eligibility
The Giveaway is open only to legal residents of the fifty (50) United States of America and the District of Columbia (“DC”) who are twenty-one (21) years of age or older at the time of entry (“Participant,” “entrant” or “you”).
Employees, officers, directors, agents, or representatives, of the Sponsor, the Administrator, their respective parent companies and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment, and execution of this Giveaway (collectively, the “Giveaway Parties”), and the immediate family (spouse, parents, siblings and children) of, and/or those living in the same household of each, are not eligible to enter.
The Giveaway is subject to all applicable federal, state, territorial, municipal and local laws and regulations. If it is found that a person who does not meet the eligibility criteria set forth in these Official Rules has submitted an entry, that entry may be deemed ineligible. Sponsor reserves the right to verify eligibility requirements. Void outside the fifty (50) United States of America and DC.
How to Enter
To enter the Giveaway, visit https://drinkjove.com/spagetaway (the “Giveaway Website”) and follow the instructions to complete and submit an entry. You will be required to provide your first name, last name, email address, city, postal code, mobile phone number, and check the box to confirm your agreement to these Official Rules and the Sponsor’s Privacy Policy. Limit of one (1) entry per person during the Giveaway Period.
By entering the Giveaway, you signify your agreement to these Official Rules and the Sponsor’s Privacy Policy.
All entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the entry. For the purpose of these Official Rules, “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an Internet service provider or other organization responsible for assigning the submitted email address. Each selected entrant may be required to provide the Sponsor with proof that the selected entrant is the authorized account holder of the email address associated with the selected entry. In the event of a dispute as to the identity of a selected entrant based on the email address, the selected entrant will be deemed to be made by the authorized account holder of the email address at the time of entry.
Entries which are incomplete, illegible or fraudulent are null and void. The Sponsor accepts no responsibility for entries that are lost, misdirected or delayed for any reason. The Sponsor accepts no responsibility for incomplete entries, the incorrect or inaccurate capture of entry information, including but not limited to as a result of malfunction, human error, lost, delayed or garbled Internet or email transmission, omission, interruption, deletion, defect or failures of any telephone, technical, network, online, hardware or software or any combination thereof.
5. Prizes/Approximate Retail Value (“ARV”)
Three (3) Grand Prizes are available to be won. Each Grand Prize is a trip for two (winner and a guest) to Vista Encantada Spa Resort & Residences (each, a “Grand Prize Trip”). Each Grand Prize Trip includes:
- 4 days/3 nights accommodations at Vista Encantada Spa Resort & Residences (for winner and a guest), valued at $3,500,
- 2 round trip flights (for each winner and a guest) to Cabo San Lucas, Mexico, valued at $1,500,
- A meal plan for winner & guest valued at $1,120,
- A Visa gift card valued at $500, and
- A spa credit at the hotel valued at $500
The ARV of each Grand Prize is $7,100.00 USD. The total ARV of all Grand Prizes is $21,300.00 USD.
Odds of winning will depend upon the total number of eligible entries received. By accepting a prize, the prize winners agree to release the Giveaway Parties from any and all liability whatsoever for any injuries, losses, or damages of any kind caused by entering the Giveaway or for damages of any kind caused by a prize or resulting from acceptance, possession, or use/misuse of any prize awarded. Grand Prizes is not exchangeable or transferable. There are no substitutions unless specified by the Sponsor. The Sponsor reserves the right in its sole discretion to substitute a portion of a prize with another prize of equal or greater value.
Prize Conditions: All expenses related to the acceptance or use of a prize are the sole responsibility of each winner. Sponsor reserves the right to use any and all information related to the Giveaway for promotional, marketing and any other purpose, including online announcements unless prohibited by law.
Travel dates are subject to availability. Certain blackout dates and travel restrictions may apply. Grand Prize winners are responsible for all transportation to and from departure airports.
The ARV of each prize represents Sponsor’s good faith determination, is final and binding and cannot be appealed. Prize elements may be subject to additional restrictions. Winners and their guests must travel together on specified itinerary. All travel dates and arrangements are subject to change based on availability and providers approval. Any portion of a prize not accepted by the winner will be forfeited.
Grand Prizes must be redeemed by December 31, 2023.
Sponsor is not responsible for any fees or additional charges resulting from winner’s or guest’s change to accommodations, or for room charges for additional amenities, services, or incidentals. Prizes are not assignable, nor transferable and cannot be redeemed for cash or other items of value except at the sole discretion of the Sponsor.
The Grand Prize winners will be required to complete an Affidavit of Eligibility & Liability / Publicity Release form and an IRS W9 tax form as a condition of acceptance of any prize. In addition, winners’ guests will be required to complete a Liability / Publicity Release in order to accompany each winner on a Grand Prize Trip. All expenses and costs not expressly listed as part of a prize and related to the acceptance and/or use of a prize are each winner’s sole responsibility.
6. Winner Selection
Three (3) potential Grand Prize winners will be selected from among all eligible entries received during the Giveaway Period in a random drawing to be held on or about September 7, 2022. The random drawing will take place at the offices of the Administrator, whose decisions are final.
7. Winner Notification
All potential winners will be notified by Administrator at the email provided at the time of entry on or about September 7, 2022. The Administrator will make a minimum of two (2) attempts to contact each potential winner within seventy-two (72) hours of the drawing date.
If any eligible potential winner cannot be contacted within seventy-two (72) hours of notification, if the prize is declined, or if there is a return of any notification as undeliverable, then the eligible potential winner may, in the sole and absolute discretion of the Sponsor, be disqualified (and, if disqualified, will forfeit any and all rights to the prize) and the Sponsor reserves the right, in its sole and absolute discretion to randomly select an alternate eligible entrant for the prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
No one is a winner unless and until the Sponsor officially confirms him/her as a winner in accordance with these Official Rules.
Before being confirmed as a winner, each potential Grand Prize winner will be required to sign and return, within seventy-two (72) hours of notification, an Affidavit of Eligibility & Liability / Publicity Release form and an IRS W-9 Form (collectively, the “Releases“). Non-compliance will result in forfeiture of the prize and the Sponsor reserves the right, in its sole and absolute discretion to randomly select an alternate eligible entrant for the prize in a separate random drawing from the remaining eligible entries submitted and received in accordance with these Official Rules.
Please note: the potential Grand Prize winners be required to furnish his/her social security number which Sponsor will use only to fulfill Sponsor’s tax obligations in connection with this Giveaway and for no other purpose.
Grand Prize winners are responsible for all federal, state, local and income taxes associated with winning a Grand Prize. The Grand Prize winners will be issued an IRS 1099 Tax Form for the retail value of prize won.
In addition, each Grand Prize winner’s guest will be required to complete a Liability / Publicity Release in order to accompany each Grand Prize winner on a Grand Prize Trip.
Prize Delivery: Sponsor will contact all winners to coordinate prize fulfillment within approximately fourteen (14) days after the winners have been confirmed.
8. Publicity
Except where prohibited by law, entry into the Giveaway and acceptance of a prize constitutes permission to print, publish, broadcast, distribute, and use, worldwide in any media now known or hereafter in perpetuity and throughout the World, the winner’s name, city, state, and prize won, as news, publicity or information and for advertising, public relations and promotional purposes without limitation and additional compensation, notification or permission.
Sponsor reserves the right to use any and all information related to the Giveaway for promotional, marketing and any other purpose, including online announcements unless prohibited by law.
9. Limitation of Liability
By participating in the Giveaway and as a condition of acceptance of a prize, each entrant, his/her heirs, executors, administrators and assigns, releases, waives, discharges, and holds harmless the Sponsor, the Administrator, their respective parent companies, and their respective subsidiaries, affiliates, suppliers of prizes, advertising and promotion agencies involved in the administration, development, fulfillment and execution of this Giveaway (collectively, the “Released Parties”) from, and against any and all loses, damages, rights, claims, actions, causes of action, personal injury, property damage or death (including without limitation any and all costs and liabilities of any kind including but not limited to lawyer’s fees), and including, without limitation, any such arising from any act of negligence of the Released Parties, that the entrant now has, or may hereafter have against the Released Parties directly or indirectly resulting from participation of the Giveaway or the awarding, acceptance, use, or misuse of a prize. Winner assumes all liability for any injury or damage caused or claimed to be caused by participation in this Giveaway or use/misuse or redemption of the prize.
FOR RESIDENTS OF THE STATE OF CALIFORNIA: You acknowledge and agree that your release and waiver extends to the following, the protections of which you explicitly waive:
California Civil Code Section 1542: A general release does not extend to claims which the creditor does not know or suspect to exist in his or her favor at the time of executing the release, which if known by him or her must have materially affected his or her settlement with the debtor.
10. General
Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Giveaway or in the announcement of the prize.
The Released Parties are not responsible for: (i) lost, late, misdirected or damaged entries; or (ii) error, omission, interruption, deletion, defect, delay in operations or transmission, theft or destruction or unauthorized access to or alterations of entry materials, or for technical, network, telephone equipment, electronic, computer, hardware or software malfunctions of any kind, or inaccurate transmission of or failure to receive entry information by Sponsor on account of technical problems or traffic congestion on the Internet or at any website or any combination thereof; or (iii) any injury or damage to Participant’s or any other person’s computer related to or resulting from participating in the Giveaway.
By participating in the Giveaway, you (i) agree to be bound by these Official Rules, including all eligibility requirements, and (ii) agree to be bound by the decisions of Sponsor, which are final and binding in all matters relating to the Giveaway.
Failure to comply with these Official Rules will result in disqualification from the Giveaway. Sponsor reserves the right to permanently disqualify from any Giveaway it sponsors any person it believes has intentionally violated these Official Rules. If for any reason this Giveaway is not capable of running as planned due to any causes beyond the control of the Sponsor which corrupt or affect the administration, security, fairness, integrity, or proper conduct of this Giveaway, the Sponsor reserves the right at its sole discretion, to disqualify any individual who tampers with the entry process, and to cancel, terminate, modify or suspend the Giveaway, at which time, Sponsor will conduct a random drawing from among all eligible entries received at the time of the Giveaway termination.
11. Disputes
Except where prohibited, Participants agree that any and all disputes, claims and causes of action arising out of, or connected with, the Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in the State of Florida. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, entrant’s rights and obligations, or the rights and obligations of the Sponsor in connection with the Giveaway, shall be governed by, and construed in accordance with, the laws of the State of Florida without giving effect to any choice of law or conflict of law rules (whether of the State of Florida or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Florida. The remedy for any claim shall be limited to actual damages, and in no event shall any party be entitled to recover punitive, exemplary, consequential, or incidental damages, including attorney’s fees or other such related costs of bringing a claim, or to rescind this agreement or seek injunctive or any other equitable relief.
THE PARTIES HEREBY WAIVE THEIR RIGHT TO JURY TRIAL WITH RESPECT TO ALL CLAIMS AND ISSUES ARISING OUT OF OR RELATING TO THIS AGREEMENT WHETHER SOUNDING IN CONTRACT OR TORT AND INCLUDING ANY CLAIM FOR FRAUDULENT INDUCEMENT THEREOF.
12. Privacy
Personal information collected from Participants is subject to the Sponsor’s Privacy Policy, which can be found at https://drinkjove.com/privacy-policy/.
In addition, we may use any personal information that you provide us in connection with the Giveaway as necessary to administer, manage and operate the Giveaway (including releasing a list of winners, as discussed below) and otherwise as permitted in our privacy policy referred to above.
13. Winners List Requests
For a written confirmation of the Grand Prize winners (available after September 15, 2022), send an email to help@raven5.com with subject line: Jovē Summer Refresh Spa Giveaway Winners List Request. All requests must be received by December 15, 2022 at 2:59:59 PM ET. Requests received after this time will not be fulfilled.
